Terms of Service

1. The service
hermes.fast is operated by Realtime Comms Ltd, a company registered in England and Wales (“we”, “us”). We provide managed virtual private servers pre-configured with the open-source Hermes Agent, together with prepaid AI inference credit served through our inference partner, gateway.fast. By subscribing you agree to these terms.
Servers are provisioned on infrastructure we rent from third-party hosting providers. The Hermes Agent itself is open-source software published by Nous Research and is provided under its own license; we install and configure it for you but do not develop it.
2. Your server, your responsibility
You receive full root access to your server. You are responsible for everything that runs on it and everything done with it, including all actions taken by the Hermes Agent, whether those actions were initiated by you, by someone you granted access to, or by automated behavior you configured.
In particular: anyone you permit to interact with your agent (for example through Discord, Telegram, or any other connected platform) can instruct it to execute commands on your server. Granting someone access to your agent is equivalent to granting them access to the server itself. You are responsible for configuring your agent’s access controls and for the actions of anyone you allow in.
3. Acceptable use
You agree not to use the service, or allow it to be used, to:
- send spam or unsolicited bulk messages;
- scan, probe, or attack networks or systems you do not own or have permission to test;
- mine cryptocurrency;
- host, store, or distribute unlawful content;
- infringe the rights of others or violate any applicable law;
- violate the acceptable-use policies of our upstream infrastructure and inference providers, which apply to your use of the service.
4. Suspension and termination
We may suspend or terminate a server without prior notice if we receive an abuse report about it, if an upstream provider requires it, or if we reasonably believe these terms are being violated. Fees for the period of suspension or for service terminated for abuse are not refundable. Where practical we will contact you before or promptly after taking action.
You may cancel your subscription at any time from the dashboard or billing portal. Cancellation takes effect at the end of the current billing period, after which your server and its data may be deleted. Back up anything you want to keep before your subscription ends.
5. Inference credits and billing
Subscriptions include a monthly inference credit allowance, and you can top up at any time. Credits are prepaid, are drawn down per token at the published per-model rates, and are non-refundable once consumed. Unused purchased credit is not redeemable for cash. When your balance reaches zero, inference requests are declined until you top up; your server itself keeps running.
Your inference API key is provisioned to your server and is your responsibility. Usage by anyone with access to your key or your agent is billed to your account.
Payments are processed by Stripe. Subscription fees are charged in advance each billing period.
6. Your data
We hold the account and provisioning data needed to run the service: your email address, billing status, server IP address and identifiers, your SSH public key, and inference usage records. Payment card details are held by Stripe, not by us. The contents of your server are yours; we do not access them except where necessary to provide support you have requested or to investigate abuse.
7. Service quality and liability
The service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted availability of servers, inference, or any particular model. AI model output is probabilistic and may be inaccurate; you are responsible for reviewing anything your agent produces or does before relying on it.
To the maximum extent permitted by law, our total liability arising out of the service is limited to the fees you paid us in the three months before the event giving rise to the claim, and we are not liable for indirect or consequential losses, lost profits, or lost data. Nothing in these terms limits liability that cannot be limited by law.
8. Changes
We may update these terms as the service evolves. Material changes will be announced on this page with an updated effective date, and your continued use of the service after that date constitutes acceptance.
9. Governing law and contact
These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts.
